Ukrnafta PJSC proposes solution to the tax debts repayment problem

Ukrnafta PJSC proposed an effective mechanism for tax debts repayment – 2 billion cubic metres of gas, which the company has on its books, are proposed as the liquidation property that can be used for this purpose.

“The property right to the gas volumes extracted in 2006, its transfer to the Unified Gas-Transportation System of Ukraine is confirmed with the acts on gas injection into underground storages of Ukrtransgaz PJSC, and rulings of economic courts of Ukraine,” reads the letter addressed to the Interregional Main Department of the State Fiscal Service – Central Office on large payers servicing (IMD SFS).

As to this volume, there is a court ruling of 19 May 2014, with which the Supreme Economic Court of Ukraine obliged Ukrtransgaz PJSC and Naftogaz of Ukraine NJSC not to prevent Ukrnafta PJSC from exercising its property right to 2 billion cubic metres of natural gas. Besides, the court ruling obliged Ukrtransgaz to withdraw the corresponding volumes of natural gas from the underground storages and to transfer this gas to Ukrnafta with execution of the necessary documents. The cost of the specified volume of natural gas, in line with prices set by the National Commission for State Energy and Public Utilities Regulation, amounts to 13.6 billion UAH that fully covers the sum of the tax debts.

This letter also contains a proposition that, pursuant to clause 89.3 of article 89 of the Tax Code of Ukraine, the Interregional Main Department of the State Fiscal Service is obliged to execute the specified property as the tax lien for its preparation for the subsequent sale.
